1. Scope and Acceptance

1.1. Applicability

These Terms and Conditions ("Terms") govern your use of the Ibex Gaming League ("IGL") website, registration system, and related services (collectively, the "Services").

1.2. Acceptance

By creating an account, registering for competitions, or using our Services, you agree to be bound by:

  1. These Terms and Conditions
  2. The IGL Official Rules
  3. Applicable game-specific rulebooks
  4. Competition-specific regulations
  5. Our Privacy Policy

1.3. Modifications

IGL reserves the right to modify these Terms at any time. Material changes will be communicated at least 7 days before taking effect. Continued use of the Services after changes constitutes acceptance.

2. Account Registration

2.1. Eligibility

To create an account, you must:

  • Be at least 16 years of age
  • Have legal capacity to enter binding agreements (or parental consent)
  • Provide accurate and complete registration information
  • Maintain a valid email address

2.2. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Updating your information when changes occur
  • Notifying us immediately of any unauthorized access

2.3. Player ID (PID)

Upon successful registration and verification, you will receive a unique Player ID (PID). This PID:

  • Remains with you across all seasons and competitions
  • Is required for team registration
  • Cannot be transferred to another person
  • May be revoked for violations of these Terms or the Official Rules

2.4. Account Termination

IGL may suspend or terminate your account for:

  • Violation of these Terms or the Official Rules
  • Providing false or misleading information
  • Engaging in fraudulent activity
  • Extended inactivity (after notice)

You may request account deletion by contacting privacy@ibexgaming.ch.

3. Competition Participation

3.1. Registration

Competition registration requires:

  • A verified IGL account with valid PID
  • Completion of all required forms
  • Acceptance of competition-specific regulations
  • Payment of applicable fees (if any)

3.2. No Guaranteed Participation

Registration does not guarantee participation. Slot allocation is based on:

  • Eligibility verification
  • Available capacity
  • Compliance with IGL Official Rules

IGL reserves the right to deny or revoke participation at its sole discretion.

3.3. Official Rules

All competition participation is subject to the IGL Official Rules. In case of conflict between these Terms and the Official Rules, the Official Rules prevail for competition-related matters.

4. User Conduct

4.1. Prohibited Activities

You agree not to:

  • Provide false or misleading information
  • Use another person's account or credentials
  • Create multiple accounts
  • Attempt to circumvent security measures
  • Use automated tools to access the Services
  • Interfere with the operation of the Services
  • Upload malicious code or content
  • Harass, threaten, or abuse other users
  • Violate any applicable law or regulation

4.2. Content Standards

Any content you submit must not:

  • Be offensive, discriminatory, or hateful
  • Infringe third-party intellectual property rights
  • Contain personal information of others without consent
  • Promote illegal activities
  • Be spam or commercial solicitation

4.3. Enforcement

Violations may result in:

  • Warning or reprimand
  • Content removal
  • Account suspension
  • Permanent ban
  • Legal action where appropriate

5. Intellectual Property

5.1. IGL Property

All content, trademarks, logos, and materials on our Services are owned by or licensed to IGL. You may not use, reproduce, or distribute these without written permission.

5.2. User Content

By submitting content to our Services, you grant IGL a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content for operational and promotional purposes.

5.3. Third-Party Rights

Game titles, publisher logos, and related materials are property of their respective owners. IGL competitions operate under applicable licenses and permissions.

6. Fees and Payments

6.1. Registration Fees

Some competitions may require registration fees. Fees are:

  • Clearly disclosed before registration
  • Non-refundable unless otherwise stated
  • Payable in Swiss Francs (CHF)

6.2. Prize Distribution

Prize distribution is governed by the IGL Official Rules, Section 9. All taxes are the responsibility of the recipient.

7. Limitation of Liability

7.1. Service Availability

IGL provides the Services "as is" without warranty of uninterrupted or error-free operation. We are not liable for:

  • Technical failures or downtime
  • Data loss due to system errors
  • Third-party service interruptions
  • Force majeure events

7.2. Liability Cap

To the maximum extent permitted by Swiss law, IGL's total liability for any claim arising from these Terms or your use of the Services is limited to:

  • The fees you paid to IGL in the 12 months preceding the claim, or
  • CHF 100, whichever is greater

7.3. Excluded Damages

IGL is not liable for indirect, consequential, incidental, or punitive damages, including lost profits, data loss, or business interruption.

7.4. Full Liability Retained

Nothing in these Terms excludes or limits our liability for:

  • Gross negligence or intentional misconduct
  • Personal injury or death caused by our negligence
  • Violations of mandatory Swiss consumer protection laws
  • Fraud or fraudulent misrepresentation

8. Indemnification

You agree to indemnify and hold harmless IGL from claims arising from:

  • Your violation of these Terms
  • Your violation of applicable laws
  • Your infringement of third-party rights
  • Content you submit to our Services

This indemnification does not apply to claims resulting from IGL's gross negligence or intentional misconduct.

9. Dispute Resolution

9.1. Governing Law

These Terms are governed by Swiss federal law and the laws of the Canton of Schaffhausen.

9.2. Jurisdiction

The courts of Schaffhausen, Switzerland have exclusive jurisdiction over disputes arising from these Terms.

9.3. Alternative Resolution

Before pursuing legal action, we encourage you to:

  1. Contact us to resolve the issue directly
  2. Use our internal appeals process (for competition matters)
  3. Consider mediation through a mutually agreed mediator

10. Consumer Rights

10.1. Statutory Rights

These Terms do not affect your statutory rights under Swiss consumer protection law, including rights that cannot be waived or limited by contract.

10.2. Unfair Terms

Any provision creating marked and unjustified disproportion between rights and obligations is void under Swiss law (UWG).

10.3. Severability

If any provision is found invalid, the remaining provisions continue in effect. Invalid provisions are replaced by valid provisions that most closely approximate the intended effect.

11. Minors

11.1. Parental Consent

Users under 18 years of age require parental or legal guardian consent to use our Services. By allowing a minor to use the Services, the parent/guardian:

  • Accepts these Terms on behalf of the minor
  • Assumes responsibility for the minor's compliance
  • Consents to the processing of the minor's personal data

11.2. Parental Oversight

Parents/guardians may:

  • Access the minor's account information
  • Exercise data protection rights on behalf of the minor
  • Request account termination

12. Communication

12.1. Electronic Communication

By creating an account, you consent to receive communications from IGL electronically, including:

  • Account notifications
  • Competition updates
  • Service announcements
  • Marketing communications (with separate consent)

12.2. Opt-Out

You may opt out of marketing communications at any time. Transactional and service-related communications cannot be opted out while maintaining an active account.

13. Third-Party Services

13.1. External Links

Our Services may contain links to third-party websites. We are not responsible for their content, privacy practices, or terms.

13.2. Integrations

Some features may require third-party services (e.g., game publishers, streaming platforms). Your use of these services is subject to their respective terms.

14. Final Provisions

14.1. Entire Agreement

These Terms, together with the Official Rules, Privacy Policy, and competition-specific regulations, constitute the entire agreement between you and IGL regarding the Services.

14.2. Assignment

You may not assign your rights or obligations under these Terms. IGL may assign its rights to an affiliate or successor.

14.3. Waiver

Failure to enforce any provision does not constitute a waiver of the right to enforce it later.

14.4. Language

The English version of these Terms is authoritative. Translations are for convenience only.
